If you are a consumer as defined by Article 3, 1st paragraph, letter a) of the Consumer Code, and a
dispute arises between you and Africa Incoming Pty Ltd that cannot be resolved directly through our
internal complaint process, we are required to provide you with information regarding Alternative
Dispute Resolution (ADR) entities that can assist in resolving consumer disputes. These ADR entities are
specified in Articles 141-bis et seq. of the Consumer Code, and we will inform you whether we agree to
utilize these ADR entities for resolving the dispute.
In addition, please be aware that a European platform for online dispute resolution (ODR) has been
established for consumer disputes. This platform is accessible at the following address: http://ec.europa.eu/consumers/odr/. Through this
platform, you can access a list of ADR entities, links to their websites, and initiate an online dispute
resolution procedure.
For cross-border disputes related to the application, execution, or interpretation of our General
Conditions of Sale, if you reside or have an address in a member state of the European Union, you may
submit a claim under the European Small Claims Procedure as per Regulation (EC) No 861/2007. This
procedure is available for claims not exceeding €500.00.
Regardless of the outcome of any out-of-court resolution process, your right to take legal action before
a competent court remains unaffected. Additionally, where applicable, you may still initiate an
out-of-court dispute resolution procedure under Chapter V, Title II-bis of the Consumer Code.
